Terms of Service

1. What Posty Is

Posty is an AI agent that helps you operate your own X (Twitter) account. The Service:

• Drafts content — posts, replies, and quote posts — for your X account, using AI, in your voice and from material you provide.
• Studies public accounts you select and public content relevant to your niche, saving public posts with source attribution as reference material to inform your content strategy.
• Publishes only with your authorization, from your own device. Original posts can publish on a schedule after you set that up; the desktop app performs publishing from your computer using your own X login while the app is running. If your computer is off or the app is closed at a scheduled time, the post is not published later automatically — it is surfaced as a draft for you to handle. Replies, quotes, and other engagement are prepared as drafts that you review and send.
• Reads your own feeds to suggest engagement. The desktop app embeds an X panel in which your own logged-in X session reads your own For-You and Following feeds at human scale. Posty does not bulk-scrape third parties and never sees or stores your X password.

Posty is a tool that acts on your instructions and with your authorization. You remain the operator of your X account and the publisher of everything posted to it.

2. Eligibility and Your Account

• You must be at least 18 years old and able to enter into a binding contract.
• You sign in with a supported sign-in method (currently Google or your X account). You are responsible for the security of that sign-in method and of any device on which you use the Posty desktop app.
• You must connect an X account that you own or are authorized to operate. You are responsible for all activity that occurs under your Posty account.
• Accounts registered by bots or automated methods are not permitted; you must be a human setting Posty up for your own account.

3. Your X Connection and the X Platform

• You connect your X account through X’s official OAuth consent. We store the resulting tokens securely server-side and use them only within the scopes you granted. You can disconnect at any time, which deletes our stored tokens.
• You must comply with X’s Terms of Service and rules when using Posty. Posty is an independent product and is not affiliated with, endorsed by, or sponsored by X Corp.
• If X changes its platform, APIs, or policies, parts of the Service may change or stop working; we are not liable for such changes or for actions X takes against your account.

4. Your Content and Ownership

• You own your content — material you provide (text, images, notes), your chats with the agent, your drafts, and the posts published to your X account.
• License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, and transmit your content solely to provide, maintain, secure, and improve the Service for you — for example, sending content to AI providers to generate drafts, storing your drafts and history, and publishing content to X on your instruction. This license ends when the content is deleted from the Service, except for routine backups or as required by law.
• AI output is yours. As between you and us, drafts generated for you through the Service belong to you, subject to the terms of the underlying AI providers and to any third-party rights in the material.
• Reference material. Public posts saved for study keep their source attribution and are for your lawful analysis and inspiration inside the Service — not for republishing third-party content as your own.

5. Acceptable Use

You agree not to use the Service to:

• send spam, run platform manipulation or coordinated inauthentic behavior, or artificially amplify content on X or any platform;
• violate X’s terms, developer policies, or automation rules;
• harass, defame, deceive, or impersonate others, or publish content that is unlawful, infringing, or fraudulent;
• infringe anyone’s intellectual property, privacy, or publicity rights;
• harvest credentials, bulk-scrape third-party data, or use Posty’s infrastructure to access data beyond your own account and the public reference material you select;
• probe, disrupt, overload, reverse engineer (except where that restriction is prohibited by law), or circumvent security or rate limits of the Service;
• resell or provide the Service to third parties without our written consent.

We may refuse, suspend, or disable accounts that we reasonably believe violate this section, with or without notice.

6. AI-Generated Content — Your Responsibility

• AI output can be inaccurate, incomplete, offensive, or otherwise unsuitable. The Service is a creative and operational aid, not a substitute for your judgment.
• You are responsible for reviewing content before it is published and for everything you approve or publish — including scheduled posts you have enabled. Enabling scheduled publishing is your authorization for those posts; review your queue accordingly.
• We make no guarantee of results — including reach, impressions, engagement, follower growth, or revenue — and no guarantee that any content will comply with X’s rules or applicable law. You are the final editorial decision-maker.

7. Plans, Billing, and Refunds

• The Service is offered on a paid subscription basis. Prices, plans, and included usage are described at posty.chat or in the app at the time of purchase.
• Merchant of record.Purchases are processed by Lemon Squeezy, LLC, our merchant of record. Your payment contract is with Lemon Squeezy, which handles payment details, applicable taxes, and payment security; card numbers never reach our servers. Lemon Squeezy’s terms and privacy policy also apply to the purchase.
• Renewal. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel anytime, effective at the end of the current period; you keep access until then. You are responsible for cancelling before renewal.
• Refunds.If Posty isn’t for you, we offer a full refund within 7 days of a charge — provided you have not used the Service since that charge, which means you have not submitted any input to the agent (no message sent through the composer) after the charge. Once you have sent the agent input in that billing period, the charge is non-refundable except where applicable consumer-protection law grants non-waivable rights. Refunds are processed through Lemon Squeezy; contact hi@posty.chat.
• Fair use.Plans include the Service’s standard daily cadence. We may throttle or temporarily limit usage that significantly exceeds normal use and degrades the Service for others; we will contact you before acting except in urgent cases.
• We may change prices with reasonable advance notice; changes apply from your next billing period.

8. Term and Termination

• You may stop using the Service and delete your account at any time; deletion is handled as described in the Privacy Policy.
• We may suspend or terminate your access (i) for material or repeated breach of these Terms, (ii) if required by law or by a platform we depend on, or (iii) if we discontinue the Service, with reasonable notice where practicable. In the event of termination for cause, no refunds are provided.
• Sections that by their nature should survive termination survive it — including Sections 4 (during wind-down of stored data), 9, 10, 11, 12, and 14.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI output, and uninterrupted or error-free operation. We do not warrant that the Service will remain compatible with X or any third-party platform. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

10. Limitation of Liability

To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, loss of goodwill, or actions taken by X or any third-party platform against your account; and (b) our total aggregate liability arising out of or relating to the Service is limited to the greater of the amounts you paid for the Service in the twelve (12) months before the event giving rise to the claim, or USD 100. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You will indemnify and hold harmless Posty and its operator from claims, damages, and reasonable costs (including attorneys’ fees) arising from (a) content you approve, publish, or provide through the Service; (b) your violation of these Terms, X’s terms, or applicable law; or (c) your infringement of third-party rights.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, excluding its conflict-of-laws rules, and disputes will be resolved in the courts of Seoul, Republic of Korea, with each party consenting to that jurisdiction. If you are a consumer in a jurisdiction whose law grants you mandatory rights or a mandatory local forum, those rights are not affected by this section.

13. Changes to These Terms

We may update these Terms from time to time. For material changes we will give notice (for example, by email or in-app) at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance; if you do not agree, stop using the Service and cancel before the changes take effect. New features are subject to these Terms.

14. General

• Entire agreement. These Terms, the Privacy Policy, and any plan terms are the entire agreement between you and us about the Service.
• Severability; no waiver. If any provision is unenforceable, the rest remains in effect; failure to enforce a provision is not a waiver.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
• Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, including outages or policy changes of third-party platforms and providers.
• Export and sanctions. You may not use the Service in violation of applicable export-control or sanctions laws.
